TRT1 – Desconhecimento da própria gravidez não anula pedido de demissão
A 4ª Turma do Tribunal Regional do Trabalho da 1ª Região (TRT/RJ) julgou improcedente o recurso de uma ex-empregada do estacionamento Menezes e Neves que requeria a anulação de seu pedido de demissão. A trabalhadora alegou que desconhecia o próprio estado de gravidez à época. O colegiado seguiu, por unanimidade, o voto da relatora do acórdão, desembargadora Tânia da Silva Garcia. A decisão manteve a sentença do juiz Igor Fonseca Rodrigues, da 6ª Vara do Trabalho do Rio de Janeiro.
A empregada, que estava havia menos de um ano no emprego, pediu demissão em 28/2/2015, tendo tomado ciência da gravidez em 30/3/2015 mediante ultrassonografia, quando já contava 19 semanas de gestação. A criança nasceu em 7/8/2015.
A defesa da trabalhadora argumentou que o nascituro é sujeito de direitos e obrigações, absolutamente incapaz, com direitos tutelados pelo Ministério Público, e que, portanto, a gestante não poderia renunciar ao período de estabilidade provisória. Além disso, o desligamento só poderia ser ratificado se assistido pelo sindicato de classe da categoria, com base em interpretação analógica do artigo nº 500 da CLT, aplicável ao empregado com estabilidade decenal.
O estacionamento recusou-se a anular a ruptura do pacto laboral, visto que foi voluntária. A empresa também se negou a pagar as verbas previstas em lei referentes ao período de estabilidade provisória gestacional.
Segundo o colegiado, não há que se falar em nulidade do pedido de demissão por irrenunciabilidade do direito à garantia do emprego à gestante, visto que se trata de ato de vontade que não padece de vício. A Turma entendeu que o artigo nº 500 da CLT, aplicado taxativamente ao empregado beneficiário de estabilidade decenal, não pode ser utilizado analogicamente, sob pena de majoração de direitos de forma não prevista em lei.
Ao enfatizar que não poderia ser exigida homologação sindical no caso, a relatora do acórdão se reportou aos termos da sentença: Mesmo que aplicável o art. 500 da CLT à situação da empregada gestante, no caso concreto não poderia ser exigida homologação sindical, já que o contrato não tinha mais de um ano, e nenhuma das partes sabia do estado gravídico. Ou seja, estar-se-ia taxando de nulo um ato por ausência de formalidade legal que nenhuma das partes tinha ciência da necessidade de observância.
Nas decisões proferidas pela Justiça do Trabalho, são admissíveis os recursos enumerados no art. 893 da CLT.
