Quais direitos trabalhistas não podem ser negociados?
Com a nova lei trabalhista, diversas matérias poderão ser objeto de negociação — mas nem tudo pode ser flexibilizado.
A reforma trabalhista ampliou as matérias que podem ser negociadas mediante convenção ou acordo coletivo de trabalho. Até então, com algumas exceções, essas negociações somente podiam estipular cláusulas, nas convenções e acordos coletivos, que não fossem mais prejudiciais ao trabalhador do que as condições previstas na legislação.
Com a entrada em vigor da nova lei, porém, diversas matérias poderão ser objeto de negociação, mesmo que criem condições menos benéficas aos trabalhadores. Contudo, apesar dessa ampliação, a lei também criou um limite ao estipular direitos que não podem ser negociados.
Alguns desses direitos que não podem ser modificados se referem à remuneração do empregado. É o caso, por exemplo, do salário mínimo, que não pode ser reduzido mediante negociação coletiva. Também não pode ser alterado o valor do 13º salário e as regras sobre proteção ao salário.
Ainda, a lei garante que não seja alterado o valor mínimo da hora extra em 50% superior ao da hora normal e assegura que a remuneração do trabalho noturno seja superior à do diurno. Assim como não permite que seja suprimido ou reduzido o adicional de penosidade, pericolusidade e insalubridade.
Porém, apesar de não ser permitida a alteração do valor do adicional de insalubridade, a lei permite que a negociação coletiva defina o grau de insalubridade a que o trabalhador está exposto, o que, na prática, pode significar a redução do seu valor.
Além disso, algumas normas sobre períodos de descanso não podem sofrer modificações, como aquelas sobre o repouso semanal remunerado. Também não podem ser reduzidos os dias de férias devidas ao empregado e nem alterada a garantia de férias anuais remuneradas com, ao menos, um terço a mais do que o salário normal.
Já no tocante aos direitos decorrentes da rescisão do contrato de trabalho, não pode ser negociado o seguro-desemprego, o valor dos depósitos mensais e da indenização rescisória do FGTS e nem o aviso prévio proporcional ao tempo de serviço, sendo no mínimo de 30 dias.
O trabalho da criança e do adolescente também foi contemplado, sendo proibido negociar as regras de proteção à criança e ao adolescente e modificar a proibição de trabalho noturno, perigoso ou insalubre a menores de dezoito anos e de qualquer trabalho a menores de dezesseis anos, salvo na condição de aprendiz, a partir de quatorze anos.
No âmbito do direito sindical, o trabalhador não pode sofrer restrição em sua liberdade sindical e nem no exercício do direito de greve.
Acrescenta-se, por fim, a proibição de alteração de normas de saúde, higiene e segurança do trabalho previstas em lei ou em normas regulamentadoras do Ministério do Trabalho, de regras sobre a aposentadoria, salário-família, licença-maternidade com a duração mínima de cento e vinte dias, licença-paternidade, entre outras.
